These Terms and Conditions govern the use of The Norwegian Foodstore website and all purchases made through our online store.

By accessing this website and placing an order, you agree to be bound by these Terms and Conditions. If you do not accept these terms, you must not use this website or place an order.

Binding Acceptance
By completing a purchase, the customer confirms that they have read and accepted these Terms and Conditions, including (without limitation) shipping terms, importer responsibility, the allocation of risk upon carrier handover, non-refundable shipping costs where permitted by law, third-party platform limitations, and payment processing conditions.

General Terms

Our Service Includes:

  • Secure packing of products for international shipment
  • Shipping via the selected shipping method at checkout
  • Issuing commercial invoices with tariff codes
  • Export of goods from Norway

Our Service Does Not Include:

  • Verification of import legality in the destination country
  • Import clearance in the destination country
  • Payment of duties, VAT, customs fees, storage fees or other import-related charges unless explicitly prepaid at checkout (where available)
  • Representation before customs authorities

Fulfilment and Transfer of Risk
All orders are fulfilled by export and shipment from Norway. Unless mandatory law in the customer’s jurisdiction provides otherwise, the seller’s contractual delivery obligation is fulfilled when the shipment is handed over to the carrier selected at checkout.

Unless mandatory law provides otherwise, risk of loss or damage transfers to the purchaser and/or recipient upon handover to the carrier (including, without limitation, delays, carrier handling, temperature variation, pressure changes, and customs intervention), regardless of the shipping method selected at checkout.

Non-Refundable Shipping / Export Handling
Shipping, export handling, and related fulfilment services (including packing, carrier booking, export processing, and documentation) are performed as part of order fulfilment. To the extent permitted by applicable law, shipping costs and export/handling charges are non-refundable once the shipment has been handed over to the carrier.

Proof of Fulfilment
Proof of fulfilment may include carrier acceptance scans, tracking documentation, export documentation, and commercial invoice records.

High Temperatures – Heat Notice (No Refrigeration)

We always ship products without refrigeration. By ordering, the customer acknowledges and accepts the risks associated with non-refrigerated transport and storage during transit.

Temperature-sensitive products
Some products (including, without limitation, chocolate, confectionery, and other heat-sensitive goods) may be affected by temperature variation during transport, customs handling, and final delivery. Most products are intended to be stored between 18–22°C (68–71°F). If you live in a location where temperatures exceed 22°C (71°F) (or are very cold), we strongly recommend not ordering products that are sensitive to temperature changes.

Transit conditions can exceed outdoor temperatures
Temperatures during transport can be higher than the outdoor temperature. Goods may be exposed to significantly more heat inside delivery vehicles, warehouses, aircraft handling environments, and during customs processing — including when vehicles are parked in direct sunlight, even for short periods.

Allocation of risk / no replacement for heat or cold impact
To the maximum extent permitted by applicable law, Norwegian Foodstore and the carrier are not responsible for melting, bloom, softening, deformation, texture changes, condensation, or other heat- or cold-related effects occurring after carrier handover or outside the recommended storage range. By ordering temperature-sensitive goods, the customer accepts this risk.

Products that normally require refrigeration
If you choose to order products that normally require refrigeration (for example: brown cheese, mayonnaise, cheese in a tube, or similar items), you must cool them down completely before consuming and keep them refrigerated after arrival. The customer is responsible for determining whether such products are suitable to order given local weather and delivery conditions.

Do not leave parcels unattended
Please ensure that packages are not left outside your home. We cannot replace products that are stolen or damaged due to being left unsupervised in heat or cold. If you choose to have the package left outside (including “leave at door” instructions), it is entirely at your own risk.

If you are unsure about product quality
If you are unsure about the product’s quality before or after receiving it, place the products in a refrigerator and contact our support team.

Natural Product Variations & Cosmetic Changes

Many of our products are food items and natural goods that may show normal variation between batches and during transport. Minor deviations in appearance, texture, color, shape, surface finish, gloss, or firmness may occur and are not considered defects, provided the product is safe to consume and within accepted quality standards.

Chocolate and heat-sensitive goods (including “fat bloom”)
Chocolate and similar products may develop visible surface changes such as fat bloom or sugar bloom due to normal temperature fluctuations during transit or storage. Such changes are cosmetic and do not affect food safety. To the extent permitted by applicable law, these cosmetic changes and normal variations are not considered damage, production defects, or grounds for a refund or replacement.

Examples of normal variations (non-exhaustive)

  • Fat bloom / sugar bloom on chocolate or confectionery
  • Minor cracking, scuffing, rubbing marks, or surface “whitening” on coatings
  • Minor deformation/softening or firmness changes due to temperature, pressure, or handling
  • Color, smell, taste, or texture variation between production batches
  • Packaging pressure changes (e.g., puffing or indentation) caused by transport conditions

Packaging, Labeling & Product Images

Product packaging, labels, and design may change over time. Product images on our website are provided for illustration purposes and may not always match the delivered item 100% in appearance, including (without limitation) packaging color, graphics, promotional markings, bundle labels, size format, or language on the label.

Supplier campaigns and temporary designs
Manufacturers and suppliers may introduce temporary packaging designs during promotional periods, seasonal campaigns, limited editions, or rebranding. Such changes do not affect the product’s identity or safety and are not considered defects.

Ingredients and declarations
The most current ingredient list and declarations are always the information printed on the product packaging. If you have allergies, dietary restrictions, or other critical requirements, you must read and rely on the label on the product itself before consumption.

If packaging/design is decisive
If packaging design, label language, or a specific edition is decisive for your purchase (for example for collecting, gifting, or display), the customer must contact our support team and confirm availability before placing an order. We cannot guarantee that a specific packaging version will be shipped unless explicitly confirmed in writing by us prior to purchase.

Where risk has transferred upon carrier handover, cosmetic changes and normal variations occurring during transit are the customer’s responsibility, to the extent permitted by applicable law.

This section does not limit any statutory rights that cannot be limited or excluded under applicable mandatory law (including where a product is materially defective, unsafe, or not fit for consumption).

Force Majeure
We are not liable for delays or non-performance caused by events beyond our reasonable control, including (without limitation) customs intervention, regulatory changes, transport disruption, carrier delay, natural events, war, labor disputes, or government action. This does not limit liability where such limitation is not permitted by mandatory law.

Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in full force, to the extent permitted by law.

Consumer Terms (B2C)

Importer Responsibility
The purchaser and/or recipient acts as the importer of record. This applies to gift orders shipped to third parties.

For gift shipments, the purchaser remains financially responsible for all import compliance, duties, taxes, customs procedures, storage fees, administrative costs, and regulatory matters, regardless of recipient location.

Import duties, VAT and other local charges remain the responsibility of the purchaser and/or recipient unless explicitly prepaid at checkout (where available).

Delays, inspections, seizures, destruction, rejections or returns caused by customs authorities, unpaid duties, missing documentation, carrier processes, or local import restrictions do not constitute failure of service by the seller, provided the seller has fulfilled its obligations under these Terms and applicable mandatory law.

Returns / Right of Withdrawal – Food Products

Due to the nature of the products sold (food items and consumables), many items are goods that deteriorate rapidly or have a limited shelf life. In addition, many items are sealed goods that may not be suitable for return once unsealed for health protection or hygiene reasons.

Where applicable consumer law permits, the right of withdrawal does not apply to (i) goods that deteriorate rapidly or have a limited shelf life, or (ii) sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed.

Where permitted by applicable law, food products are therefore exempt from the right of withdrawal once delivered, and/or once seals are broken, and/or where the nature of the goods makes them unsuitable for return.

Products exposed to temperature variation, broken seals, opened packaging, pressure changes, or transit-related environmental conditions cannot be returned, to the extent permitted by law.

For customers located outside the EEA, all sales of food products are final once shipped, to the extent permitted by applicable law. Returns are not accepted except in cases of documented production defects or other situations where mandatory law requires remedies.

30-Day Returns (General Policy)

Return window
We offer a 30-day return policy from the date you receive your order. To initiate a return, you must contact our support team within 30 days of delivery and obtain return instructions before sending anything back.

Condition of returned goods
Returned products must be unused, unopened, and in their original packaging, and must be suitable for resale (including intact seals where applicable). We reserve the right to refuse returns that do not meet these conditions, to the extent permitted by law.

Return shipping costs
The customer is responsible for all return shipping costs and any costs related to returning the shipment (including, without limitation, shipping, handling, customs clearance, duties, taxes, and administrative fees). Original shipping costs are non-refundable to the extent permitted by applicable law.

International returns / customs
For international returns, the customer is responsible for ensuring the return is properly declared and that all import/export and customs requirements are met. Any costs incurred due to incorrect declarations, unpaid charges, or customs issues will be deducted from any refund where permitted by law.

Refunds
Once we receive and inspect the returned goods, we will issue a refund for the returned products to the original payment method. Refunds are issued in NOK. Payment provider fees and currency conversion differences may apply as described in these Terms.

Business-to-Business (B2B)

Business customers waive consumer protection rights to the extent permitted by applicable law.

Risk transfers upon handover to the carrier, unless otherwise agreed in writing.

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential losses including loss of profit, business interruption or reputational damage.

Payments & Disputes

Currency and Refunds
Refunds are issued in NOK (Norwegian kroner). Currency fluctuations and payment provider fees remain the customer’s responsibility to the extent permitted by applicable law.

All transactions are processed in NOK unless otherwise stated. Currency conversions displayed at checkout are indicative and may differ from final bank settlement amounts due to third-party conversion rates and fees. The seller is not responsible for discrepancies caused by financial institutions or payment providers.

Chargebacks and Payment Disputes
The seller reserves the right to contest any payment dispute or chargeback by providing documentation showing fulfilment and carrier handover, including tracking and export documentation, to the extent permitted by applicable law.

Platform & Payment Provider Display Errors
Norwegian Foodstore is not liable for incorrect, delayed, or incomplete display of shipping costs, duties, taxes, currency conversions, or total order amounts caused by third-party payment providers, gateways, financial institutions, currency services, or the e-commerce platform (including Shopify). Any claims relating to such technical or display errors should be directed to the relevant payment provider or platform operator, without prejudice to any mandatory statutory rights that cannot be waived.

Improper Payment Disputes
Where export service has been fulfilled and goods have been handed over to the carrier, initiating a payment dispute solely for reasons related to customs regulations, import duties, carrier delays, platform display errors, disclosed transit risks, or conditions communicated prior to purchase may be deemed unfounded. The seller reserves the right to submit full documentation to the payment provider and, where permitted by law, recover reasonable administrative costs associated with responding to the dispute.

Intellectual Property

All content including text, product descriptions, translations, images, graphics, structure, layout and design is the intellectual property of The Norwegian Foodstore unless otherwise stated.

Unauthorized commercial use may result in claims for compensation, damages, and recovery of legal costs, to the extent permitted by law.

Hyperlinking to Our Content

The following organizations may link to our website without prior written approval:

  • Government agencies
  • Search engines
  • News organizations
  • Online directory distributors
  • Systemwide accredited businesses

Links must not be misleading, imply endorsement, or damage our reputation. No use of our logo is permitted without written license.

Iframes

Without prior written approval, you may not create frames around our web pages or use other techniques that alter the visual presentation of our website.

User Comments

Users may post comments where functionality allows. Comments reflect the views of the author only.

We reserve the right to monitor and remove comments deemed inappropriate, unlawful, or in breach of these Terms.

You warrant that your comments do not infringe third-party rights and do not contain unlawful, defamatory, or abusive material.

Content Liability

We shall not be responsible for content appearing on third-party websites. You agree to indemnify and defend us against claims arising from your website, to the extent permitted by law.

Reservation of Rights

We reserve the right to request removal of links to our website and to amend these Terms at any time. Continued use of the website after changes are published constitutes acceptance of the updated Terms, to the extent permitted by law.

Removal of Links

If you find any link on our website objectionable, you may contact us. We are not obligated to remove links but may do so at our discretion.

Cookies

We use cookies in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential losses.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by mandatory law.

Governing Law

These Terms are governed by Norwegian law.

The ordinary courts of Norway shall have jurisdiction, with Bergen District Court (Bergen Tingrett) as venue, to the extent permitted by mandatory consumer protection legislation.
